Phenomenology refers to the philosophical and scientific study of consciousness and the objects of direct experience. This book includes four chapters that explore phenomenology from several perspectives. Chapter One examines Augustine's paradox as the formula of a philosophical problem through the lens of the phenomenological concept of the horizon. Chapter Two employs the tenets of hermeneutic phenomenology and the method of path-dependent process tracing to interrogate the "longue durée" historical experience of Ghana from 1951 to 1992 to probe the evolutionary (...) dynamics of its democracy. Chapter Three presents ongoing research on a phenomenological ontology of forms of life. As sharing and secondary research use of biospecimens increases, IRBs and researchers face the challenge of protecting and respecting donors without comprehensive regulations addressing the human subject protection issues posed by biobanking. Variation in IRB biobanking policies about these issues has not been well documented.

This study investigates the relationship between mental health and emotional intelligence among senior high school students in a public school. Thus, the study employed a correlational design to measure the relationship between mental health and emotional intelligence among 152 Grade 12 senior high school students in a public school. Hence, to measure the study’s variables - Mental Health Inventory and Emotional Intelligence Scale (EIS) were utilized. Based on the inferential statistics, the r coefficient of 0.32 indicates a low positive correlation (...) between the variables and a p-value of 0.00, indicating a significant relationship between the respondents' mental health and emotional intelligence. This essay illustrates what the Chinese family-based and harmony-oriented model of medical decision making is like as well as how it differs from the modern Western individual-based and autonomy-oriented model in health care practice. The essay discloses the roots of the Chinese model in the Confucian account of the family and the Confucian view of harmony. By responding to a series of questions posed to the Chinese model by modern Western scholars in terms of the basic individualist concerns and values (...) embedded in the modern Western model, we conclude that the Chinese people have justifiable reasons to continue to apply the Chinese model to their contemporary health care and medical practice. While hedonism has been subjected to much criticism over the years, it is still a widely endorsed axiological view. One objection that appears to be generally recognised as especially troublesome to hedonists is that their central claim, that final value accrues only to experiences of pleasure gives us a narrow view of value. Much more than pleasure is valuable for its own sake. A competing theory, preferentialism, is another widespread theory about value. According to one version of preferentialism, only the (...) objects of preferences carry final value, and since not all of our preferences have pleasure as their object, preferentialists accuse hedonists of overlooking a great deal that is of value. For instance, if someone has a so-called external preference to the effect that, say, the Californian redwood forests should go on existing, then the world contains more value if the forests continue to exist.1 Given this, the possible pleasure someone would experience on learning that his preference is satisfied has nothing to do with this kind of value. Preferentialists therefore conclude that the hedonist perspective is not wide enough. In this work, it is argued that hedonists are entitled to reverse the argument. The excitement generated among philosophers by Chomsky's work arises not only from his contributions to the study of language but also from the ramifications of his work for general issues of epistemology and the philosophy of science. Chomsky has been attacking cherished dogmas of empiricism and its ally, behaviorism. He has suggested that Descartes—the favorite whipping boy of contemporary philosophers—and his theory of innate ideas provide a fruitful starting point for understanding and appreciating recent work in transformational linguistics. In this (...) brief historical essay, he sets forth what he takes to be the chief doctrines of Cartesian linguistics and traces their development through the nineteenth century. The essay is self-consciously written from a contemporary perspective and the topics selected for discussion are those which anticipate and are related to contemporary empirical linguistics. The importance of the creative aspect of language use, the distinction between deep and surface structure in language, the belief in a universal grammar are the key themes of this stimulating study in the history of ideas.—R. Commonsense says we are isolated. After all, our bodies are physically separate. But Seneca’s colamus humanitatem, and John Donne’s observation that “no man is an island” suggests we are neither entirely isolated nor separate. A recent discovery in neuroscience—that of mirror neurons—argues that the brain and the mind is neither built nor functions remote from what happens in other individuals. What are mirror neurons? They are brain cells that process both what happens to or is done by an individual, and, (...) as it were, its perceived “refl ection,” when that same thing happens or is done by another individual. Thus, mirror neurons are both activated when an individual does a particular action, and when that individual perceives that same action done by another. The discovery of mirror neurons suggests we need to radically revise our notions of human nature since they offer a means by which we may not be so separated as we think. Humans unlike other apes are adapted to mirror interact nonverbally when together. Notably, our faces have been evolved to display agile and nimble movements. While this is usually explained as enabling nonverbal communication, a better description would be nonverbal commune based upon mirror neurons. I argue we cherish humanity, colamus humanitatem, because mirror neurons and our adapted mirror interpersonal interface blur the physical boundaries that separate us. (shrink)

The philosopher Ludwig Wittgenstein chose as his prime exemplar of certainty the fact that the skulls of normal people are filled with neural tissue, not sawdust. In 1980 the British pediatrician John Lorber reported that some normal adults, apparently cured of childhood hydrocephaly, had no more than 5 % of the volume of normal brain tissue. While initially disbelieved, Lorber’s observations have since been independently confirmed by clinicians in France and Brazil. Thus Wittgenstein’s certainty has become uncertain. Furthermore, the paradox (...) that the human brain’s information content appears to exceed the storage capacity of even normal-sized brains, requires resolution. This article is one of a series on disparities between brain size and its assumed information content, as seen in cases of savant syndrome, microcephaly, and hydrocephaly, and with special reference to the Victorian era views of Conan Doyle, Samuel Butler, and Darwin’s research associate, George Romanes. Through staged photographs in which she herself is often the lead actor or through appropriation of historical photographs, contemporary African American artist Carrie Mae Weems deconstructs the shaming of the black female body in American visual culture and offers counter-hegemonic images of black female beauty. The mirror has been foundational in Western theories of subjectivity and discussions of beauty. In the artworks I analyze in this article, Weems tactically employs the mirror to engage the topos of shame in order to (...) reject it as a way of seeing the self and to offer a new way of lovingly seeing the self. I use the work of Kelly Oliver, Helen Block Lewis, and bell hooks to articulate the relationships among the mirror, shame, and black female subjectivity in Weems's work. Weems's subjects often reckon with what Oliver calls “social melancholy” as they experience shame while standing before the mirror. However, Weems also shows that by looking again—a critical strategy I explain using Oliver's model of “the loving eye”—her subjects can use the mirror as a corrective to the social shaming gaze and make it a stage for establishing black female subjectivity, a gaze of self-love, and beauty. By employing poetic elements in their use of language, such texts attempt to convey deep metaphysical truths (...) and philosophical positions about reality that are in many cases quite different from Western ideas (Babbili 1997). Often, these ways of conveying truths are an integral part of that truth. One particularly useful form is narrative, taking instantiations such as a dialogue between characters. Philosophical dialogues such as the Bhagavad Gita and the Astavakra Gita (also known as the Astavakra Samhita ) use a portrayed conversation involving a guru or deity to convey didactic lessons and values to the receptive audience, both ancient and modern. We ask God to involve himself providentially in our lives, yet we cherish our freedom to choose and act. Employing both theological reflection and philosophical analysis, the author explores how to resolve the interesting and provocative puzzles arising from these seemingly conflicting desires. He inquires what sovereignty means and how sovereigns balance their power and prerogatives with the free responses of their subjects. Since we are physically embodied in a physical world, we also need to ask how this is (...) compatible with our being free agents. Providence raises questions about God's fundamental attributes. The author considers what it means to affirm God's goodness as logically contingent, how being almighty interfaces with God's self-limitation, and the persistent problems that arise from claiming that God foreknows the future. Discussion of these divine properties spills over into the related issues of why God allows, or even causes, pain and suffering; why, if God is all-knowing, we need to petition God repeatedly and encounter so many unanswered prayers; and how miracles, as ways God acts in the world, are possible and knowable. Justice has always been regarded as one of the fundamental political virtues. No association of human individuals could subsist, says Hume, “were no regard paid to the laws of equity and justice”, and nearly every thinker who has turned to consider human society, has reached the same conclusion. Yet we are not at all clear what justice is, nor why it is so important. There are many other ideals which a society may cherish, and often reformers have felt impatient (...) of having to compromise their aims merely for the sake of justice, and have not seen why the claims of justice should in any way override other political goods. I shall try to show why justice is, along with liberty, a peculiarly fundamental ideal, which is not merely co-ordinate with other ideals a society may value; but also that this notwithstanding, considerations of justice are not all-sufficient, and do not, and should not, always override all other political ideals. The next steps in health reform, like all such efforts before it, will have to engage the issue of American health care federalism – the relationship between the federal and state governments in the realm of health law and policy. Since its enactment in 2010, the Patient Protection and Affordable Care Act has offered a robust example of modern federalism and revealed new complexities. This article recounts the findings of our five-year study of the federalist and nationalist features of ACA (...) implementation. Contrary to the claims of ACA opponents that the law marked a federal “takeover,” the ACA's governance structures have advanced rather than suppressed state power. But we also found that the advances in state power occurred seemingly independently of the statute's structural arrangements; that is, the ACA's nationalist and federalist features both enhanced state power over health policy. These findings raise questions about whether cherished American federalism values are unique to federalist structures; they also raise the question of what exactly health care federalism is for, and why we continue to design health policy with federalism front and center. It is not clear that enhanced state power has brought better health policy. If it has not, is federalism for its own sake worth the trade-off? (shrink)

Water values serve as an entry point into the intricacies of public policies and management approaches. Values are contingent assessments that emerge out of socio-ecological relations and reflect particular demands, legacies and opportunities. The concept of value positionality is introduced as the synthesis of multiple expressions of worthiness cherished by a social group. Positionality is a metaphor that connects the phenomenological understanding of water value with the politics of everyday life and the broader politico-institutional framework. It entails a cluster of (...) meanings expressed through territorialised interactions across time, locations and scales. The military might of the modern era poses devastating threats to humankind. Wars result from struggles for material or ideological power. In this context the probability of flouting agreements made during peaceful times is great. The rights of victims and the rights of medical personnel are vulnerable to State and military momentum in the quest for sovereignty. Scholars, scientists and physicians enjoy little enough influence during times of peace and we should be sanguine about their influence during war. But we (...) also must avoid becoming co-opted by partisan political forces. The universal ideals for which we strive, need to be cherished and kept central in our field of vision if we are to rise above man's basest instincts and if we are to preserve professional integrity, individuality and humanitarian concern for the sanctity of life — even the lives of our foes who are engaged in battle against us. Such compassion also recognizes the coercion implicit in recruiting persons into wars they detest and which pits them against their own image. Man's inhumanity to man, most evident during war, must not be allowed to pervade the sanctuary of medical care. Health professionals must constantly be encouraged to serve humankind with empathy and compassion and great social effort needs to be expended to facilitate this role globally and under all conditions. Richard DeGeorge argues that they can be defended on ethical grounds only if they are joined with appropriate accountability, publicly articulated and defended standards, and conscientious enforcement of these standards by academic institutions and the members of the academic community.

RESUMEN El artículo examina el consuelo como una cuestión filosófica en cuanto que concreción de la solicitud, y muestra los recursos que aporta para comprender al ser humano como sujeto sufriente y respondiente. Se analiza el consuelo en cuanto que fenómeno de acceso a otras dimensiones constitutivas del ser humano, como la afectividad, la apelación y el cuidado. In The Contemplative Self after Michel Henry: A Phenomenological Theology, Joseph Rivera provides a close and critical reconstruction of the philosophical anthropology of Michel Henry (1922-2002) while also addressing the question of how theology contributes to Henry's phenomenology. In conversation with other French figures such as Derrida, Marion, Lacoste, and Barbaras, Rivera undertakes a global thematic study of Henry's work. He shows how, for Henry, the theological debate is shifted onto a phenomenological problem, with a coincident will to (...) pursue the epistemological efforts of Husserl and Heidegger. The chapters tackle some of the most pressing debates in contemporary Continental philosophy, such as the "modern ego," the nature and experience of temporality, and the constitution of the body and otherness, and how a theological discourse may illumine those anthropological structures. The book expands on the modern narrative of the self from Descartes to Nietzsche, opens up the particular lines of inquiry Henry advances in dialogue with those figures and phenomenology in particular, and highlights the surprising theological turns in Henry's late work on Christianity. Because Henry's work is difficult, it is often misunderstood; Rivera's own vision of the self, one that is shaped by Henry but not in full agreement with him, advances insights internal to Henry but also brings into sharp focus many problematic points in Henry's phenomenological theology. An array of classical theological voices appear in the final chapters, such as St. Augustine, Tertullian, Irenaeus, Pseudo-Dionysius, and Gregory of Nyssa, all of whom are set in dialogue with Henry. A fresh and creative articulation of contemplation and selfhood, the volume is a valuable addition to the continuing conversation that seeks to build bridges between phenomenology and theology. Consensual homicide remains a crime in jurisdictions where active voluntary euthanasia has been legalized. At the same time, both jurisdictions, in which euthanasia is legal and those in which it is not, recognize that all patients (whether severely ill or not) have the right to refuse or withdraw medical treatment (including life-saving treatment). In this paper, I focus on the tensions between these three norms (the permission of active euthanasia, the permission to reject life-saving treatment, and the prohibition of consensual (...) homicide), assuming a justification of euthanasia based on the right to (personal) autonomy. I argue that the best way to provide a coherent account of these norms is to claim that patients have two distinct rights: the right to autonomy and the right to bodily integrity. This solution has some relevant implications for the discussion of the legalization of active euthanasia. (shrink)

Edited by Ivette Fred-Rivera and Jessica Leech. What is the relationship between ontology and modality: between what there is, and what there could be, must be, or might have been? Throughout a distinguished career, Bob Hale’s work has addressed this question on a number of fronts, through the development of a Fregean approach to ontology, an essentialist theory of modality, and in his work on neo-logicism in the philosophy of mathematics. This collection of new essays engages with these themes (...) in Hale’s work in order to make further progress in our understanding of ontology, modality, and the relations between them. Some essays directly address questions in modal metaphysics, drawing on ontological concerns. Others raise questions in modal epistemology and its links to matters of ontology, such as the challenge to give an epistemology of essence. There are also several essays engaging with questions of what might be called ‘modal ontology’: the study of whether and what things exist necessarily or contingently. Such issues can be raised and addressed directly, but they also have an important bearing on the kinds of semantic commitments engendered in logic and mathematics, e.g., to the existence of sets, or numbers, or properties, and so on. It is thus explored in some chapters to what extent one’s ontology—and indeed, one’s ontology of necessary beings—interacts with other plausible assumptions and commitments. (shrink)

In his recent article, ‘A Gift to Theology? Jean-Luc Marion's ‘Saturated Phenomena’ in Christological Perspective’, Brian Robinette has critiqued Marion's phenomenology for confining theology to a one-sided approach to Christology, one that stresses only the passive, mystical reception of Christ. To correct this imbalance, Robinette brings Marion into dialogue with those more active Christologies or ‘prophetical-ethical’ liberation theologies of Gustavo Gutierrez, Johann Baptist Metz and others that stress a life-praxis focused on confronting evil and suffering. In this essay I am (...) arguing that Robinette has not fully developed the ‘logic’ of Marion's phenomenology of the ‘call and the gifted’, in which both a passive and an active element are operative. I explore more fully that very dynamic phenomenological process of the call-and-the-gifted as developed in Marion's work Being Given: Toward a Phenomenology of Givenness. Once viewed in Christological perspective, and especially in light of Christ's death and resurrection, Marion's phenomenology entails an ethical trope consistent with the mission of Christ as rendered in Scriptural revelation, and thus the gap between Marion's work and the prophetical-ethical theologies of Gutierrez and Baptist Metz becomes narrowed.
